Terms & Conditions

Introduction

  1. Welcome to BIGVU – an online platform enabling users to produce videos with comprehensive tools for capturing, modifying, and publishing content. The Application comprises an iOS/Android mobile app (via Apple App Store and Google Play) and web-based software at www.bigvu.tv, collectively referred to as the "Services".
  2. The Services are owned and operated by BIGVU Inc., 135 WEST 50 STREET, NEW YORK, NY 10020, USA.
  3. ACCEPTANCE OF TERMS: By clicking "I AGREE" or using the Services, you agree to be bound by these Terms. If you disagree, you may not access or use the Services.
  4. These Terms apply across all communication means (smartphones, tablets, etc.) and may be subject to additional third-party terms from app stores and social networks.
  5. UPDATES TO TERMS: BIGVU may modify these Terms at any time. Changes become effective immediately upon posting. Continued use indicates acceptance of amendments. Disagreement requires cessation of use.
  6. You consent to automatic downloading and installation of Service updates.

The Application and Services

  1. BIGVU provides tools to create, edit, publish, and watch videos via mobile and web apps.
  2. The Application produces videos ("Products") for any purpose.
  3. ELIGIBILITY: The Services are NOT for persons under 13 years old. Users must be at least 18 or have parental authorization.

License

  1. BIGVU grants a worldwide, limited, revocable, non-exclusive, personal, non-transferable license to access and use the Services per these Terms.
  2. You may access and use the Services for personal and commercial purposes.
  3. The License permits commercial use—defined as any video use deriving direct or indirect commercial benefit or pecuniary gain.
  4. FREE-OF-CHARGE SERVICES: Some Services are free but include the BIGVU watermark. BIGVU may convert free Services to paid, with advance notice and your consent required. Refusal allows BIGVU to block access.
  5. PAID SERVICES: Remove the BIGVU watermark by converting to a "Paid Account" per Website fees. Automatic billing occurs from conversion date and each renewal until cancellation. You're responsible for applicable taxes.
  6. Paid Services serve individual persons or single organizations authorizing employees/contractors.
  7. Paid Accounts remain active until cancelled or terminated. You may cancel anytime. Refunds issued only if legally required.
  8. BIGVU provides advance notice via email for fee changes.
  9. BIGVU may require additional fees for future features. Rates post on relevant pages, taking effect immediately. Non-payment prevents Service access. No refunds provided except as legally required.

Content

  1. BIGVU encourages caution with third-party content (photos, background covers, music). BIGVU makes no representations regarding accuracy, completeness, credibility, authenticity, validity, integrity, or legality. You release BIGVU from all claims resulting from Service use. Content use is entirely at your risk.
  2. Optional music tracks synchronize in Products, granting a nonexclusive license to reproduce, synchronize, publicly perform, and communicate the synced Product publicly. Music use is restricted to Product creation only.
  3. You agree to abide by all applicable local and international laws, regulations, and BIGVU usage guidelines. You bear sole responsibility for acts/omissions associated with Service use.
  4. PROHIBITED USES: You agree NOT to:
    1. Deliberately or unintentionally interfere with Application operation/functionality
    2. Use the Application in unpermitted ways
    3. Collect/compile information impairing Service functionality
    4. Use robots, crawlers, or similar applications
    5. Probe, scan, test vulnerabilities, or breach security/authentication measures
    6. Collect personal information without prior explicit consent
    7. Impersonate persons/entities or make false identity statements
    8. Breach these Terms or other applicable rules
    9. Violate applicable laws
    10. Transmit spam or unsolicited bulk communications
  5. PROHIBITED CONTENT: You agree NOT to upload, post, provide, transmit, or make available content that is:
    1. Fraudulent, misleading, or inaccurate
    2. Breaches proprietary rights (copyrights, patents, trademarks, trade secrets, IP)
    3. Violates third-party privacy or other rights
    4. Abusive, harassing, threatening, vulgar, violent, obscene, or offensive
    5. Harms minors
    6. Computer code/viruses/malicious applications
    7. Slander, libel, defamation, invasion of privacy, or otherwise unlawful
    8. Encourages/assists criminal conduct or violates applicable laws
  6. USER RESPONSIBILITY: You are solely responsible for content uploaded or disseminated via the Services and associated consequences. Use is entirely at your own risk.
  7. BIGVU may suspend/terminate access without notice if fraudulent/abusive use is determined.
  8. BIGVU respects third-party intellectual property. Notices of alleged infringement (copyright/trademark) are addressed per law. BIGVU reserves right to delete infringing content and terminate repeat offenders' accounts.
  9. Unless expressly permitted, you may NOT copy, distribute, display, exploit, sublicense, decompile, disassemble, adapt, commercialize, compile, translate, sell, lend, rent, reverse engineer, or create derivative works of IP-protected Service content without prior written authorization.
  10. USER-GENERATED CONTENT: BIGVU hosts user-generated content. Offensive content remedy is cessation of viewing. Report offensive content to support@bigvu.tv.
  11. BIGVU respects third-party IP rights and responds timely to clear infringement notices per Israeli law.

Content Bank – Community Use of AI-Generated Assets

  1. Visual assets created via BIGVU's AI features (AI-Generated B-Roll, AI Backgrounds) are automatically added to a shared community content bank accessible to all BIGVU users. These assets are shared by default with no privacy option.
  2. By using these features, you acknowledge that generated content may be used by BIGVU and other users. You grant BIGVU and all users a non-exclusive, worldwide, royalty-free, perpetual license to use, reproduce, display, and distribute AI-generated content. You're solely responsible for content nature and must not include personal, sensitive, confidential, or third-party data without necessary rights/permissions. BIGVU assumes no responsibility for personal data or third-party content included.
  3. Third parties believing personal data appears in AI-generated content should contact support@bigvu.tv.

Registration and Creation of an Account

  1. Service use and Account creation require registration. You must provide contact/personal information (full name, active email, username, password) and represent that: (a) all registration information is truthful/accurate; (b) you'll maintain accuracy. Delete your Account anytime by contacting support@bigvu.tv. You're responsible for Account login confidentiality and all Account activities. Notify BIGVU immediately of unauthorized use/suspected breaches. BIGVU bears no liability for loss/damage from Account use.
  2. You're fully accountable for registration outcome and Account use/misuse. Update/modify details anytime via personal account settings.
  3. Logging into third-party services (social networks) via the Application grants BIGVU access to profile information (photos/videos, music, emails, etc.). BIGVU only accesses information your social network operator provides per your privacy settings and granted authorizations. Only you initiate and control third-party account access/actions. BIGVU doesn't store account passwords.
  4. BIGVU uses personal information per its Privacy Policy.
  5. YouTube account connection binds you to YouTube Terms of Service.

Account Termination

  1. You're free to stop using the Services/Application anytime.
  2. BIGVU may discontinue Services anytime due to unforeseen circumstances or legal requirements. Reasonable prior notice allows Product download. BIGVU may discontinue Services, in whole or part, temporarily or permanently, for all or certain users.
  3. BIGVU may deny, limit, suspend, or terminate accounts and block access if: (a) Terms breached; (b) illegal acts/omissions performed; (c) acts/omissions harmful to BIGVU/third parties; (d) false information deliberately submitted.
  4. Upon termination, BIGVU reserves right (but has no obligation) to delete all information, Products, videos, and data. BIGVU bears no liability for access termination or information/video/data deletion.

Privacy

  1. BIGVU respects privacy. The Privacy Policy is available at https://bigvu.tv/privacy-policy. Service use involves third parties (service providers, social networks, photo banks, etc.) potentially subject to additional terms and privacy policies.
  2. BIGVU follows California Consumer Privacy Act (CCPA) "personal information" rules. Categories of collected, used, disclosed, and shared personal information are detailed at https://bigvu.tv/privacy-policy.

Commercial Information in the Services

  1. BIGVU may incorporate advertisements/commercial information. Third-party information sources cannot be guaranteed reliable/accurate. BIGVU disclaims liability for inaccurate, unreliable, untimely, or incomplete information or reliance thereon.
  2. Third-party advertisers use technology to send advertisements/links directly to your browser via automatic IP address receipt. They may use cookies/JavaScript to measure advertisement effectiveness and personalize content. BIGVU assumes no responsibility for third-party information use.
  3. The Services may contain links to third-party websites/content. Linking doesn't constitute endorsement or accuracy confirmation. BIGVU assumes no responsibility for external site availability/resources. You release BIGVU from all liability arising from third-party website use. BIGVU bears no responsibility for third-party damage/loss.

Intellectual Property

  1. All rights, titles, and interests in the Services (patents, copyrights, trademarks, trade names, service marks, designs, pictures, trade secrets, IP rights, and associated goodwill) are owned by or licensed to BIGVU.
  2. Service Content (text, photos, music, interactive features) may be copyright-protected or owned by BIGVU/third-party licensors and may only be used for Product creation via the Application. Unauthorized Content use remains subject to owner rights.
  3. You may NOT use third-party artworks, designs, trademarks, creations, or IP-infringing works. BIGVU assumes no responsibility for third-party IP infringement caused by your use. You release BIGVU from all liability.
  4. PUBLICITY: You grant BIGVU the right to publicize that you're a Service user.

Changes in the Services

  1. BIGVU may maintain Services with periodic bug fixes, code updates, or upgrades at sole discretion regarding frequency/scope. You have no claim against BIGVU/staff for releases or lack thereof. BIGVU assumes no responsibility for changes or resulting malfunctions/failures.
  2. BIGVU may change layout, design, scope, features, or availability anytime without notice. Changes may cause inconvenience/malfunctions. BIGVU assumes no responsibility for changes or resulting malfunctions/failures.

Availability and Support

  1. BIGVU endeavors to ensure proper Service operation. However, BIGVU accepts no responsibility/liability for temporary unavailability due to technical/uncontrollable issues. BIGVU doesn't warrant uninterrupted, error-free, always-available, or unauthorized-access-immune operation. Availability/functionality depend on partially third-party-provided software, hardware, and communication networks prone to faults.
  2. Create Product/Content backups. You bear sole responsibility for adequate data/equipment protection/backup. BIGVU may store content/Products temporarily—downloading immediately post-creation remains your responsibility.
  3. BIGVU may offer technical support in formats/frequencies/scopes/schemes determined at sole discretion. You have no claim against BIGVU/staff regarding this provision.
  4. BIGVU shall NOT be liable for loss or indirect, consequential, incidental, special, or punitive damages from Services or inability to use, even if advised of possibility. Service access/use is entirely at your discretion/risk—you bear sole responsibility for computer system/Product damage or data loss.

Disclaimer of Warranty

BIGVU provides the Service and Content "AS IS". The Application cannot customize to every user's needs. All warranties/representations, express or implied, are disclaimed, including merchantability, fitness for particular purpose, quality, non-infringement, title, compatibility, performance, security, or accuracy. Uninterrupted/error-free/always-available/harmful-component-free operation is not warranted. Use is entirely at your own risk.

Limitation of Liability

BIGVU, including officers, directors, shareholders, employees, sub-contractors, and agents, will not be liable to maximum extent permitted by law for any direct, indirect, incidental, consequential, or other damage/loss (including profit/data loss), costs, expenses, payments—in tort, contract, or other liability form—arising from Service failure, error, breakdown, content reliance, or Service communication. Your sole remedy is BIGVU's sole-discretion-limited correction of errors/malfunctions per relevant circumstances.

Indemnification

  1. You agree to indemnify and hold BIGVU (and its officers, employees, agents) harmless, including costs/attorney fees, from any third-party claim/demand arising from: (i) Application/Services use; (ii) User Content; (iii) other User interaction; (iv) Agreement violation or applicable law violation. BIGVU reserves right to assume exclusive defense/control at your expense. You agree to cooperate with defense. No settlement without prior BIGVU written consent. BIGVU will use reasonable efforts to notify you of such claims/actions/proceedings upon awareness.
  2. You agree to defend, indemnify, and hold BIGVU, officers, directors, and employees harmless at your expense from claims, actions, demands, liabilities, and settlements (including reasonable legal/accounting fees) resulting from your Services use/access or these Terms/third-party right violations.

Governing Law, Jurisdiction

  1. These Terms are governed by Israel State law and construed per Israeli law. Parties irrevocably submit to Israel's courts' exclusive jurisdiction and Courts of Appeal.
  2. NO CLASS ACTIONS: Disputes resolve individually only—no class, consolidated, or representative actions.

Severability

If any Terms provision is held illegal, invalid, or unenforceable by competent court, it shall perform/enforce to maximum permitted extent, with remaining Terms provisions continuing in full force/effect.

General

  1. No waiver, concession, extension, representation, alteration, addition, or derogation from the Terms by BIGVU is effective without explicit written consent from BIGVU's authorized representative. BIGVU's failure to demand provision performance doesn't constitute waiver.
  2. Notice under these Terms must be written and signed by the party/its agent. Receipt occurs: (a) hand-delivered notices upon delivery; (b) email notices upon recipient/recipient's email server receipt confirmation.

Sales Taxes and VAT

  1. Website purchases may include sales tax or VAT based on billing address and local regulations. Final checkout price may include additional charges per location.
  2. Sales tax/VAT is calculated per billing address region tax rates. Rates/regulations vary significantly by region, affecting additional amounts based on location.
